Land Dispute: Meadows Family Takes Possession of Demolished Monkey Village in Opebi

*Warns land grabbers, illegal occupants to stay away from property
*Demands public apology from former VP of NBA, Ubani or risk litigation
Following the controversy trailing the demolished illegal structures and shanties on a landed property located at Folorunsho Kuku Street in Opebi area of Lagos State, known as ‘Monkey Village’, the G.W. O Meadows Family, has taken full possession of the property.

Speaking to journalists on Monday, Mr. Francis Monye, the Solicitor to Prosperous Ariyori Golden Ventures, the land developer that was given the concession by G.W.O Meadows Family to develop and manage the land, said they are acting based on several ruling of the courts which declared Meadows Family as the rightful owner of the property.  
 
The legal practitioner said the possession of the land was based on the ruling of the Lagos High Court in Suit No: LD/513/80 and Court of Appeal in Suit No: CA/1/16A/92, as well as the ruling of the apex court, the Supreme Court in SC146/1995, which were all in the favour of the G.W.O Meadows family. 
 
“It is not good to have illegal shanties within a city like Lagos. The place has become a haven for all sorts of crimes; people who are illegal immigrants living there. It is more like a training front for robbers; a place where they stashed proceeds of crimes. They come here to keep either stolen vehicles or stolen materials and this place also became a kind of terror to the environment. Most of the people in the shanties are people without any means of reasonable means of livelihood,” he said. 
 
Also speaking the solicitor to G.W.O. Meadows family, Mr. Yakubu Arowosola Eleto, warned land grabbers and illegal occupants to vacate the property and also called on the former Second Vice President of the Nigeria Bar Association, Mr. Monday Ubani, to desist from laying claims to the property. 
 
The legal practitioner who took a swipe at Ubani for accusing the land developer, Engr. Abiodun Ariori of using officials of the Lagos State Government to illegally grab the said land from his client, who he said has Certificate of Occupancy, C.of.O and other documents validating his ownership of the land, gave the former NBA vice president another three days to tender public apology after the completion of the earlier seven days ultimatum. 
 
He said failure to do so; he will take a legal action by filing a defamation suit against Ubani for defaming the land developer.   
 
Some of the residents at the shanties who spoke to journalists on Monday disclosed that they occupied the land and erected different structures without taking permission from land owners or the state government. 
 
“I have been living in this place for over 30 years. When I came here, it was a thick forest; I cleared it, developed it and built some ‘mansions’ at the place. I didn’t take any approval from government or the owner of the structure because it was a bush. I also have a church here. We have a lot of people living here and we don’t have anywhere to go after the demolition,” a man who identified himself as Pastor Osagie told journalists.

CMB Real Estate MD, Kelechi Mbagwu, Remanded Over Alleged N25m Fraud

Being Investigated For Another N2.8bn Fraud, EFCC

Mr. Kelechi Mbagwu, the Managing Director of CMB Building Maintenance and Investment Limited, builder of Pearl Estate, Sangotedo-Ajah, Lagos, has been remanded in the custody of the Economic and Financial Crimes Commission (EFCC), by the Special Offences Court, Ikeja, Lagos.

The court presided over by Justice Sherifat Solebo, ordered the remand of Mr. Kelechi, after he was arraigned before the court on four counts charge of conspiracy, stealing, obtaining by false pretence and fraud.

The EFCC through its prosecutor, Mr. Mohammed Idris, during the arraignment of the defendant on Friday, told the court that Kelechi and his company, had between February 12 and September 14, 2018, conspired among themselves and fraudulently obtained the sum of N25 million, from one Okafor Ameachi Sixtus, under false pretence of selling to him two Residential plots of land in Pearl Garden Estate, Sangotedo.

Idris told the court that upon receiving the mentioned money, Kelechi dishonesty and fraudulently converted it to his personal use, while also failed and refused to give out the plots of land to the fraud victim.

Idris told the court that the offences committed by Kelechi and his company, CMB Building Maintenance Limited, contravened section 411 and punishable under Section 287 (5)(a) of the Criminal Law of Lagos state, 2015. And section 1(3) and 8(a) of Advance Fee Fraud and Other Fraud Related Offences Act No 14 of 2006.

Upon reading of the charge to the defendant, he denied the allegations and pleaded not guilty to all the counts of the charge. 

Following the not guilty plea of the defendant, the prosecutor asked the court for a trial date, while also urged the court to remand him in the custody of the Nigerian Correctional Services (NCoS), till the determination of the charges against him.

But the dfendant’s counsel, Mr. R. A. Aladesanmi, pleaded with the court not to remand his client in the custody of the NCoS, but to remand him in the custody of the EFCC, pending when his bail application will filed, argued and determined.

 In a bench ruling, Justice Solebo, while adjourning the matter till February 2, 2021, for trial, ordered that the defendant be remanded in the custody of the EFCC.

Speaking on Kelechi’s arraignment, the prosecutor, Mr. Idris, said the charge brought against him on Friday, is just one in many petitions against him, as the commission is still investigating him in another 13 other cases, in which he is alleged to have defrauded several people of about N2.8 Billion.

• Governor Addresses Property Investors At LASRERA’s Maiden Real Estate Conference

Beginning from first quarter of next year, all land related transactions in Lagos State will be undertaken online, Governor Babajide Sanwo-Olu disclosed on Wednesday.

The plan, the Governor said, is to further accelerate the process of getting approvals on land matters and create an enduring business-driven property development market in the State.

Sanwo-Olu made the disclosure at the maiden Real Estate Marketplace Conference and Exhibitions organised by Lagos State Real Estate Regulatory Authority (LASRERA), with the theme: “Unearthing real opportunities in Real Estate.”

The Governor said the State’s Department of Lands had built the required capacity for smooth transition to the online platform, stressing that the plan was already in its final stage.

When the web-based platform is finally launched, there will be no need for applicants seeking for Certificates of Occupancy (C of O), survey and building plan approvals to physically submit paper documents for authorisation. All documentation and payments will be done by applicants from the comfort of their homes.

Sanwo-Olu said the new development would bring about quick turnaround time in land transactions and boost private investors’ confidence in provision of home ownership model that will address deficits in housing.

He said: “We have improved on our GIS solution to accelerating land matters in Lagos. From the first quarter of next year, we will be launching an online platform on which all land transactions will be done. When the project kick-starts next year, there will be one-stop shop for all transactions relating to land, including Governor’s approval on CofO, and building approval by Ministry of Physical Planning and Urban Development.

“We have given our commitment on this, because of the need to improve the turnaround time from when people submit their requests for approval and the time the authorisation is completed. We cannot afford to disappoint private investors and applicants seeking real time approval. We are raising our capacity, so that we can respond to the requests and discharge them.”

The Governor charged residents and property developers applying for approvals to stop cutting corners and circumventing the process, stressing that sharp practices would only make it difficult for impatient applicants to get their documents approved.

Sanwo-Olu said his administration was committed to providing mass housing scheme that would address inadequacy in housing, pointing out that the establishment of LASRERA was part of the move to re-build integrity in housing market and gain confidence of private developers working with the Government to realise the State’s housing need.

The Governor also harped on the need for massive regeneration of properties in mainland part of Lagos, charging real estate investors and private developers to divert their investment to rebuilding mainland and redistributing wealth from the business.

He said: “I need to charge the real estate investors that, everybody needs not build in Sangotedo or Ibeju Lekki. Let us go to mainland and start regeneration of the assets in that part of Lagos. This way, we would be redistributing wealth and creating opportunities for our citizens.

Special Adviser to the Governor on Housing, Mrs. Toke Benson-Awoyinka, said the conference was held with an objective to bring stakeholders in property business in contact with relevant Government agencies and address bottlenecks slowing down property transactions.

She said LASRERA was created with a mandate to bridge the gap of credibility in property business, pointing out that the Government responded to the yearnings of industry players, having realised there were genuine real estate practitioners and property developers, as well as genuine home and property seekers who were desirous of credibility in real estate transactions in Lagos.

Benson-Awoyinka said the regulatory agency, since inception, had set processes in motion to change the negative image of property development business and check malpractices which the sector had faced in the last decades.

She said: “As a Government that is determined to bridge the housing deficit in the State, we are aware of our role in not just the provision of houses, but also create an enabling environment for the private sector working hand in hand to a desired end.

“We are making a renewed appeal to investors in the sector to team up with the State Government to create a home ownership model that will help address the deficits observed in housing market in the State our through Public Private Partnership (PPP) initiative in providing mass housing for our people.”

There conference featured exhibitions for home marketing firms, Government and private property developers.

There was also a panel of discussion in which private practitioners, heads of relevant Ministries and agencies provided explanations on housing market can be improved.
